Mediation and Arbitration

MediationMediation, early neutral evaluation, and to a lesser extent, arbitration, have greatly increased in use and popularity over the past several decades.  Alternative dispute resolution (ADR) as these forums are collectively known, offers savings in time and money, and is private and confidential.

David Cleary has seen a substantial increase in demand for his services as a mediator, particularly in cases of greater significance.  He is a favorite of both plaintiff and defense attorneys alike due to his experience, attention to detail, and the ability to zero in on the key issues in the case to present all the risks and rewards of continued litigation to the parties.  His many years of litigation practice as counsel for both plaintiffs and defendants has given him the background, experience, persuasive ability, and perseverance to be considered one of Vermont’s most sought-after mediators.

He was (and remains) a member of Vermont’s Federal Court Advisory Committee, which drafted the U.S. District Court of Vermont’s Local Rules regarding Early Neutral Evaluation, and is proud to be one of the original early neutral evaluators for Vermont.

He is a member of the National Academy of Distinguished Neutrals.
